Private Mediation and Arbitration of construction disputes, certainly including earth-movement disputes, is being utilized with much frequency in California. Additionally, the Courts are now ordering these cases into Mediation and Arbitrator almost as a normal course, particularly in light of the severe court congestion in the metropolitan areas.

Our practice has very much included this type of dispute resolution for many years. Mr. Rubbert has served as a privately selected Mediator and Arbitrator as well as a Court-appointed Mediator and Arbitrator. In this setting, we can provide assistance by bringing in our professional experts for consultation to aid in the dispute resolution, including civil engineers, geologists, geotechnical engineers, appraisers, grading engineers, etc.

The hearings can be held in any setting including the courts. We have held Arbitration hearings on the project-site with the engineers presenting their input in the presence of the parties and their attorneys. We frequently use videotape interviews and depositions for Mediations and Arbitrations to reduce the cost.
