General Construction LitigationWe also specialize in general Construction litigation of which earth-movement litigation is, of course, one aspect. This highly specialized area of practice of Construction Project litigation involves alleged construction deficiencies. The construction litigation clients most typically are general contractors, subcontractors as well as property owners whose properties have been affected, directly and sometimes indirectly, by alleged construction defects and related events, or in the alternative, the developers, builders, engineers, contractors and others involved in the construction about which complaint is made. In California, these are significant problems with so much construction taking place. We have represented Freeway construction general contractors and builders as an example. This type of litigation is extremely complex, usually involving a multiplicity of lawsuits by and between the property owners and the construction entities, as well as technical insurance litigation by and between the insurance carriers for those parties, particularly developers and contractors. Closely inter-related are Condemnation and/or Inverse Condemnation actions arising from the described events. It is typical to see much appellate litigation arising from this litigation taking place as it progresses. All of this Inter-party litigation, appeals and condemnation actions usually take place concurrently, and we are very accustomed to such a legal environment. Closely related in this type of practice is working with structural engineers, grading engineers, civil engineers, foundation engineers, chemical engineers and other professionals, including those with Governmental entities. Often this inter-related work pertains to evolving plans for theremediation of the alledged construction deficiencies or factors causing the events in conjunction with Governmental agencies and construction industry personnel. Most often, the goal of litigation is to accomplish a repair as well as compensation to the damaged owners. Bringing about a repair invariably involves working very closely with the many representatives of those various Governmental agencies controlling the subject matter in question. In short, getting a permit to proceed with repair, a very major challenge!
